Guys I have one question concerning Extended Licence usage. There is one Codecanyon item that I am interested in buying and later using it in my own theme on Themeforest. It has EXTENDED LICENCE available to buy. The thing is that author of this item claims that embedding it into the theme isn’t allowed. How is it possible ? Under Extended License it clearly says “a website template for sale (including on ThemeForest or ActiveDen)” . I am confused now. I thought that if someone on Codecanyon doesn’t want his item being used in themeforest theme he will offer only regular item. So does it actually work ?
If the author of the CodeCanyon item doesn’t want you to use his item in your Themeforest theme, then he should not be offering the Extended Licence.
The Extenced Licence clearly states that the code can be used with “a website template for sale (including on ThemeForest or ActiveDen)” as you already pointed out.
Simply put: if you want to buy the extended licence then the author you’re talking to is wrong to tell you that you cannot use the code in your theme and should take another look at his/her own available licences.

+1 Paul – Out of courtesy I would email the author and explain what you wish to do and highlight (politely) the exert from the t&c of extended licensing that allows you to do this. If they still have an issue then contact support.

The new license terms make you to also get the written approval of the author, don’t matter the license. The extended license isn’t only for ThemeForest, so if we wants to keep it, he can. If he tells you that you can’t resell on ThemeForest, he can tell you so.
So actually buying extended licence doesn’t make any sense.
Let’s say I see useful item on CODECANYON . That clearly says ” I buy extended license, I integrate it with my own theme on themeforest. Author of that item may come up anytime soon and say: “Sorry dude, you are selling too much.I envy you, and I don’t want you to use my stuff.”
So to sum it up the term: “a website template for sale (including on ThemeForest or ActiveDen)” should be mark with stars ** and additional line of text: “NOT REALLY , WE ARE ONLY KIDDIN ”

Ruben do you mean this point in Extended Licence: ?? : III . You use the Work alone as a Limited Re-Purposing, but only if: (A) you first obtain the permission of the author of the Work (by contacting the author through the marketplace contact system);
Is integrating codecanyon plugin into themeforest theme a Limited Re-Purposing ???? I just can’t get it :/

maybe i miss something, but what is appelton asking is subject of point C. I) from extended license terms. According to that he doesnt need a written accord. is not talk about Limited Re-Purposing.
for instance, “A jQuery slider from CodeCanyon could be used in a theme for sale.” – subject of extended license and not of Limited Re-Purposing (where do you need author agreement).

If I purchase an extended license of an item, can I include it in a project that I will sell?
The answer is, yes … in 3 cases. These are the 3 categories in which it’s acceptable, and they’re now clarified in the extended license wording:
1. When you include the item in a larger project
The larger project is usually not a template or stock item. Meaning, what you’re selling is meant for the end user, not something the buyer would modify and use in another project. For example, you could sell a final product like an app, shirt, movie, or printed material. Occasionally, the larger project is a template item. For example, you could use a button graphic in a WordPress theme you sell. (On the other hand, you could not convert an HTML template to WordPress, as this is not a larger project.) Here are more examples of what is considered a “larger” project.
2. When you modify a template or software app to create an end product
This means customising a template or software app item, to create and re-sell an end product on a stand alone basis, but not as a stock item. For example, you can use a magazine template to create and sell the final printed magazine to consumers. More examples here.
3. When you modify the item to create a similar item, get permission from the author, and only sell on the Envato marketplaces
This means not putting the item into a larger project, but modifying it in some way and re-selling it as a template or stock item. For example, using an HTML template and converting it to a WordPress theme to sell on ThemeForest. This is called a ‘Limited Repurposing’ in the updated extended license, and can only happen with the permission of the original author and then only if your item is sold on an Envato marketplace. If you’re the author of an item and another author asks you for permission to modify or convert it and re-sell it as a stock item, it is entirely up to you whether to agree. Think about whether you’re planning to sell the proposed modification yourself or if you’re happy for another author to do and re-sell the work. Your incentive would be your share on the extended license fee. If you, as an author, do decide to give permission, you should keep track of what permissions you’ve given out. Of course, you wouldn’t want to give out overlapping permissions on the same item, which would result in duplicate items being uploaded to the Envato marketplaces.
Your project must meet ONE of the use cases above to be able to include the extended licensed product in your project.
I believe the OP here falls firmly in the #1 option – including a plugin in a theme is using that plugin in a Larger Project, so it’s case #1. No need for permission.
Permission beyond the license is only required in case #3, which is the Limited Repurposing. The example here is turning a CodeCanyon jQuery plugin into a CodeCanyon WordPress plugin. I do not believe that Code Canyon Plugin > ThemeForest WordPress Theme is considered limited repurposing, as you’re creating an entirely new product, of which the plugin is only single component.

I believe the CodeCanyon author is wrong; however, that being said, you may want to consider their wishes (if you haven’t already purchased the license) – clearly they have misunderstood, and should opt out of the Extended License; though I believe you’re within your rights to purchase and use the extended license as you’ve described.
